Illinois Becomes First U.S. State to Ban AI Therapy Without Human Oversight

In a landmark move, Illinois has banned artificial intelligence platforms like ChatGPT from providing therapy services without licensed human supervision. Governor JB Pritzker signed the Wellness and Oversight for Psychological Resources Act, making Illinois the first state to pass such a law.

The regulation prohibits AI from creating treatment plans, assessing mental health, or giving therapeutic advice without oversight. Violations could lead to fines of up to $10,000, enforced by the Illinois Department of Financial and Professional Regulation.

Officials stress that while AI can assist with tasks like scheduling and documentation, core therapy must remain human-led. The law follows warnings from the American Psychological Association about risks linked to AI chatbots posing as therapists.

Other states are moving in the same direction—Nevada, Utah, and New York have already introduced restrictions on AI-driven mental health tools.

The decision highlights the growing debate between innovation and ethics. Experts argue that while AI can expand access, it lacks empathy and judgment, making human oversight essential.

For Illinois, the message is clear: in mental health care, AI can support—but not replace—humans.
